The terms and conditions detailed below apply to orders on our website and for delivery to the UK.By placing an order, you agree to be bound by these Terms and Conditions at the date of sale. Your statutory rights are not affected by these terms
. Ordering/Purchasing Products
The placing of an order by a customer is considered to be an offer to the company to purchase goods at the current price advertised. As part of the checkout process you will be given the opportunity to check your order and make any changes. An order acknowledgment email will be sent detailing the products you have ordered. This email constitutes acceptance of you order. However your order may still not be accepted after confirmation where:
We cannot obtain authorisation for your payment
The type of goods you ordered are not available, in which case we may offer a substitute of the same quality and type. However we will not substitute without prior consent of the purchaser .If this is not satisfactory we will arrange for a refund or credit.
If it is logistically impossible for us to deliver the goods to that address.
.Delivery charges and/or surcharges apply which have not been paid.
If an error has occurred and an item has been underpriced. We will not be liable to supply that item at the stated price. We will notify you of the correct price before dispatch, allowing you to decide whether you wish to continue with the purchase. If not, we will give you a full refund
Prices are quoted in British pounds (£) and are inclusive of VAT, include delivery and are accurate at the time published, but may be subject to change
.A delivery charge may apply to certain remote parts of the UK- see Delivery for details.
All prices must be paid in full before goods are dispatched.
Payment is taken when we receive your order.
Please note that any delivery time scales stated on our website are only estimates.
Whilst we endeavour to deliver all orders within this period, we do not accept liability and offer no compensation for failure to meet the delivery estimate.
.If we are unable to deliver within the time scale stated we will only proceed with your order after contact with you.
.Orders received after 1pm on weekdays, on Saturdays and Sundays, or public holidays will be processed the next working day. We do not normally deliver on weekends, but if we agree an additional charge may be levied, which you will be informed of when placing your order. There are no deliveries on public holidays
.It is the customer’s responsibility to ensure when placing an order that full delivery address details, including an accurate postcode of the delivery address, a daytime telephone number and a correct email address is given, so we can notify you should any problems arise with your order or delivery.
If you cannot be present to accept and sign for your delivery and want the goods to be left unattended, please notify us prior to the delivery date in writing, by email, post or by leaving a signed note to this effect. We will normally contact you prior to the estimated delivery date to inform you of the exact date on which your goods will be delivered.
If you miss the delivery of your order, you will incur a re-delivery charge as we will have met our original obligation to deliver with our first attempt at delivery
We normally operate a policy of kerb-side delivery and our driver will not ask for any assistance unless it is offered by the customer.

.Delivery will be deemed as successfully made once the product has arrived at the address specified so long as the product has been signed for by an adult aged 18 or over, or alternately the purchaser has left a signed note to say the goods can be left unattended and left unsigned for. Any loss or damage to the products will be at your own risk.
For delivery to certain locations such as hotels, business premises, hospitals, airports etc, the signature of any person authorised to accept delivery on behalf of that company or organisation shall be accepted as proof of delivery of the goods to the buyer.
We advise that you do not arrange any third party ancillary services, (for installation) until goods have been delivered. We cannot be held responsible for any unnecessary expense incurred in this matter where the delivery estimate has been relied on but not met.
For oversized items, where machinery is needed, ie forklift, to complete delivery, it will be the customer's own responsibility to obtain and pay for this at the time of arrival.
Shortages should be notified to us within 48 hours of delivery by calling us on 07970 772743 or email .
We may not accept claims for damaged goods if the courier/driver has obtained a clean signature and there is no mention of damage on the delivery note
.Any damages must be reported to us within 48 hours of receipt of the goods. We will require you to send us photographic evidence of the damage. We will then take appropriate action.
If for any reason you decide you wish to return any items, we will refund you the amount paid for the plants, excluding the delivery fee.
A 25% service and re-stocking charge will apply
.Goods must be returned within 14 days of receipt at the buyers expense using their own transport arrangements.
We will use the same method for refund as the original purchase.
Items must be returned in a saleable condition.
Please be aware there are a small amount of plant varieties which we cannot accept returns for.
We cannot accept returns for those plants which have been re potted, planted in the ground or altered in any way.
Any plants which have arrived damaged must be reported to us within 48 hrs by email, along with photographic evidence. We will do our upmost to help and resolve the issue.
We cannot however be held responsible for any damage incurred during transit when external courier companies are used.
We only dispatch healthy plants of excellent quality and free of disease.
Plants are living things and as such they must be maintained and cared for by the customer.
If the plants you have chosen becomes un- available, we will email or telephone immediately to arrange a refund or alternative. We will never send an alternative without approval.
We do not accept responsibility for plants failure due to planting, soil, weather or any other factor beyond our control
Photographs and images on the website are used to represent the style of the product.
Whilst many of the photos have been taken of some of our actual stock, no two plants are exactly the same, and therefore natural variations in colour, form and size may occur.
Whilst we do our upmost best to make sure the information on our website is correct we cannot guarantee 100% accuracy. For example: plant hardiness temperature ratings do vary according to different areas in the UK. Occasional inaccuracies or errors may occur which we expressly exclude liability for.
The website contains material which is owned by The Palm Tree Company and includes, but is not limited to the design, look, layout, appearance, photos and graphic images.
